Brand Risk Picks Discord ("Service," "we," or "us"), a subscription-based Discord community providing sports betting picks, insights, and related content operated by Brand Risk Picks. These Terms and Conditions ("Terms") are a legally binding contract between you and Brand Risk Picks regarding your use of the Service. By accessing or using the Service, including subscribing to our Discord community, you agree to be bound by these Terms, our Privacy Policy, and any additional policies referenced herein. If you do not agree to these Terms, you may not use the Service.
PLEASE READ THESE TERMS CAREFULLY.
ARBITRATION NOTICE: Except for certain disputes described in Section 15, you agree that disputes arising under these Terms will be resolved by binding, individual arbitration, and by accepting these Terms, you and Brand Risk Picks are each waiving the right to a trial by jury or to participate in any class action or representative proceeding.
1. Service Overview
Brand Risk Picks operates a subscription-based Discord community, Brand Risk Picks Discord, where users ("Subscribers") can access sports betting picks, analysis, and related content provided by Brand Risk Picks or its contributors ("Content Providers"). The Service is hosted on Discord, a third-party platform, and may include additional features such as community discussions, exclusive channels, or other digital content. Brand Risk Picks does not provide gambling services, place bets on your behalf, or operate as a bookmaker. All picks and insights are for informational and entertainment purposes only and do not guarantee success.
2. Eligibility
To use the Service, you must:
•Be at least 18 years old, or the legal age for sports betting in your jurisdiction, whichever is higher.
•Reside in a jurisdiction where accessing sports betting information is legal.
•Not have been previously suspended or removed from the Service.
•Comply with all applicable laws and regulations, including those related to sports betting.
By agreeing to these Terms, you represent and warrant that you meet these eligibility requirements. If you are subscribing on behalf of an entity, you represent that you have the authority to bind that entity to these Terms.
3. Accounts and Registration
To access the Service, you must register for an account and link a valid Discord account ("Linked Account"). You may also need to provide personal information, such as your name and email address, and payment information through our third-party payment processor. You agree to:
•Provide accurate, complete, and up-to-date information.
•Maintain the confidentiality of your account and accept responsibility for all activities under your account.
•Notify us immediately at support@brandriskpicks.com if you believe your account is no longer secure.
Account Ownership: The individual or entity controlling the Linked Account with the payment method is considered the account owner. Only the account owner may request changes to the Linked Account.Know Your Customer (KYC): To comply with payment processing and legal requirements, you may be required to complete identity verification through our third-party payment processors. Failure to complete KYC may result in restricted access to funds or account suspension.
4. Subscription and Payment Terms
Subscription Service: The Service operates on a subscription model with recurring payments ("Subscription Fee"). By subscribing, you authorize Brand Risk Picks or its third-party payment processor to charge the Subscription Fee to your provided payment method on the billing date and each renewal date thereafter until cancellation.
•Billing Date: Your subscription begins on the date of your first payment ("Subscription Billing Date") and renews automatically for the specified period (e.g., monthly) unless canceled.
•Cancellation: You may cancel your subscription at any time by following the cancellation steps in your account settings or by contacting us at support@brandriskpicks.com. Cancellations must be received before the renewal date to avoid charges for the next billing period.
•No Refunds: All Subscription Fees are non-refundable, except where required by applicable law.
Pricing: Brand Risk Picks reserves the right to set and change pricing for the Service. Current pricing is available at brandriskpicks.com or on the Brand Risk Picks Discord server. We will provide advance notice of material price changes.
Taxes: Where applicable, we may add sales or use taxes to the Subscription Fee, which will be collected and remitted to the appropriate tax authorities or transmitted to you for reporting, as required by law.
Delinquent Accounts: We may suspend or terminate access to the Service for accounts with unpaid amounts. You are responsible for any fees or costs associated with collecting unpaid amounts, including chargeback fees.
Chargebacks and Disputes: Excessive chargebacks, refunds, or disputes may result in account suspension or termination. You are responsible for any associated costs, and we may withhold funds to cover potential liabilities.
5. Nature of Sports Betting Picks
No Guarantees: All sports betting picks and insights provided through the Service are for informational and entertainment purposes only. Brand Risk Picks does not guarantee the accuracy, reliability, or success of any picks. Sports betting involves significant financial risk, and you assume all responsibility for any losses incurred.
Not Financial Advice: The Content Providers are not licensed financial advisors. The Service does not provide financial, investment, or gambling advice. You should consult a qualified professional before making betting decisions.
Compliance with Gambling Laws: You are solely responsible for ensuring that your use of the Service and any subsequent betting activities comply with all applicable laws in your jurisdiction. Brand Risk Picks does not facilitate gambling transactions or act as a bookmaker.
6. Discord Community Access
Access to Community: Upon subscribing, you will be granted access to the Brand Risk Picks Discord community, subject to compliance with these Terms and any Community Terms set by Brand Risk Picks. We may manage the Discord community, including adding or removing members, to maintain the integrity of the Service.
Linked Discord Account: You must link a valid Discord account to access the community. You authorize Brand Risk Picks to manage your Discord account for the purpose of granting access to the community.
Community Conduct: You agree to comply with Discord's Terms of Service and our Community Guidelines, available on the Brand Risk Picks Discord server. Prohibited conduct includes, but is not limited to:
•Sharing or leaking content from the Service without permission.
•Engaging in harassment, hate speech, or disruptive behavior.
•Promoting competing services or soliciting other Subscribers.
7. Intellectual Property and User Content
Ownership: All content provided through the Service, including sports betting picks, analysis, and community materials ("Service Content"), is owned by Brand Risk Picks or its Content Providers and is protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service Content for personal, non-commercial use, subject to these Terms.
User Content: You may post content in the Brand Risk Picks Discord community, such as messages or feedback ("User Content"). By posting User Content, you grant Brand Risk Picks a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content in connection with the Service.
User Content Representations: You represent and warrant that:
•You own or have the necessary rights to post your User Content.
•Your User Content does not infringe any third-party rights or violate any laws.
•Your User Content is accurate, honest, and not misleading.
Prohibited Content: You may not post User Content that is illegal, obscene, defamatory, harassing, or otherwise objectionable. We reserve the right to remove or block User Content that violates these Terms.Earnings Claims: Any User Content related to betting results or earnings must be accurate, substantiated, and not misleading. You must disclose any material expenses or atypical results.
8. Prohibited Conduct
You agree not to:
•Use the Service for illegal purposes, including violating gambling laws.
•Share, sell, or disclose Service Content without permission.
•Use automated tools (e.g., bots) to access or scrape the Service.
•Engage in fraudulent activity, such as impersonating others or manipulating payment systems.
•Interfere with the operation of the Service or other users' enjoyment.

9. Third-Party Services
The Service is hosted on Discord, a third-party platform. Your use of Discord is subject to Discord's Terms of Service and Community Guidelines. Brand Risk Picks is not responsible for Discord's availability, performance, or content. Payments are processed by third-party payment providers, and you agree to comply with their terms.
10. Termination
By You: You may terminate your account at any time by canceling your subscription and contacting us at support@brandriskpicks.com.
By Us: We may suspend or terminate your account or access to the Service at our sole discretion, with or without notice, for reasons including:
•Violation of these Terms or Community Guidelines.
•Non-payment of Subscription Fees.
•Suspected fraud or illegal activity.
Effect of Termination: Upon termination:
Your access to the Service and Brand Risk Picks Discord community will cease.
•You must pay any outstanding amounts owed.
•You may lose access to Service Content and User Content.
•Sections 7, 10, 11, 12, 13, 14, and 15 will survive termination.
Account Balances: Any funds held by our payment processor will be handled in accordance with their policies, including potential offsets, refunds, or escheatment for unclaimed funds.
11. Indemnity
You agree to indemnify and defend Brand Risk Picks, its affiliates, and their respective officers, employees, and agents from any claims, liabilities, damages, or expenses (including attorneys' fees) arising from:
•Your use or misuse of the Service.
•Your violation of these Terms or applicable laws.
•Your User Content or disputes with other users.
•Your betting activities or reliance on Service Content.
12. Disclaimers and No Warranties
The Service and all Service Content are provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. Brand Risk Picks does not warrant that:
•The Service will be uninterrupted, secure, or error-free.
•Sports betting picks will be accurate or result in winnings.
•Your use of the Service will comply with applicable laws.
You use the Service at your own risk and are solely responsible for any losses or damages resulting from your use of the Service or reliance on Service Content.
13. Limitation of Liability
To the fullest extent permitted by law, Brand Risk Picks and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages (including loss of profits or betting losses) arising from your use of the Service, whether based on contract, tort, or other legal theory.
Our aggregate liability for any claims related to the Service is limited to the amount you paid for the Service in the 12 months prior to the claim.
Any claim arising from these Terms must be initiated within one (1) year of the event giving rise to the claim, or it will be permanently barred.
14. Dispute Resolution and Arbitration
Arbitration Agreement: You and Brand Risk Picks agree to resolve disputes arising under these Terms through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, except as noted below. Arbitration is less formal than a court proceeding and is subject to limited judicial review.
Exceptions: Either party may:
•Bring an individual action in small claims court.
•Pursue enforcement actions through applicable agencies.
•Seek injunctive relief in court to aid arbitration.
•File a lawsuit for intellectual property infringement claims.
Opt-Out: You may opt out of arbitration within 30 days of accepting these Terms by sending a written notice to support@brandriskpicks.com with your name, account email, and a statement opting out of arbitration.
Arbitration Process:
•Send a written Notice of Arbitration to support@brandriskpicks.com, describing the claim and relief sought.
•If unresolved within 30 days, either party may commence arbitration.
•Arbitration hearings will occur in the county/state of your residence or as agreed, and may be conducted by documents, phone, or in person for claims under $10,000.
No Class Actions: Claims may only be brought in an individual capacity, not as part of a class or representative proceeding.
Governing Law:
•For Users in the United States: These Terms are governed by the laws of the State of New York without regard to conflict of law principles. Any non-arbitrable disputes will be resolved in the state or federal courts of New York, NY.
•For Users Outside the United States: These Terms are governed by the laws of the State of New York, unless prohibited by the laws of your jurisdiction, in which case the laws of your jurisdiction will apply to the extent required. Any non-arbitrable disputes will be resolved in a court of competent jurisdiction in your country or region, subject to applicable law.
15. Miscellaneous
Entire Agreement: These Terms, including the Privacy Policy and Community Guidelines available on the Brand Risk Picks Discord server, constitute the entire agreement between you and Brand Risk Picks regarding the Service.
Assignment: You may not assign these Terms without our prior written consent. We may assign these Terms at any time without notice.
Modifications: We may update these Terms periodically. Material changes will be effective 30 days after posting or notice, and continued use of the Service constitutes acceptance.
